Terms and conditions of use of the site
1. Introduction
TREID SAS, domiciled in Medellín, Republic of Colombia, and identified with NIT 900.856.843-0 (hereinafter TREID), makes available the terms and conditions of use of the services offered through the web portal www.treid.co. Access to services implies acceptance of these Terms and Conditions by Subscribers. Likewise, any violation of these guidelines will result in the exclusion or exit of the offender from the information system that supports our web portal.
2. Definitions
For purposes of contributing to the interpretation of these terms and conditions of use, the following definitions are incorporated:
Electronic Commerce: It includes the sending, transmission, reception, and storage of data messages electronically. Doubts that arise regarding the effectiveness and validity of data messages and other activities related to electronic commerce will be interpreted in accordance with Law 527 of 1999.
Subscription: Subscription is understood to be the contract entered into between the SUBSCRIBER and TREID that allows access to the databases provided at www.treid.co and to carry out structured consultation according to the chosen plan.
Plan: they are the group of services to which the SUBSCRIBER is entitled and to which they can access according to the selection made at the time of hiring.
Subscriber: The natural or legal person that contracts the services with TREID, assuming the rights and obligations agreed in the contract.
User: The user will be the natural person who is part of the subscriber's organization, and who is delegated by him to use the services on his behalf and under his responsibility.
Personal data: Any information linked or that may be associated with one or more specific or determinable natural persons; that is supplied voluntarily by the Subscribers.
Purpose: Principle that consists of the use or purpose for which the information requested from customers is collected during the registration process or after it.
Data Message: Information generated, sent, received, stored or communicated by electronic, optical or similar means, such as, among others, Electronic Data Interchange, Internet, electronic mail, telegram, telex or telefax.
Information Processing: Any operation or set of operations on personal data, such as the collection, storage, use, circulation or deletion.
3. Description of the service.
Through the web portal www.treid.co TREID makes available to Subscribers information of a public nature that has been collected, refined and arranged in an organized manner, related to transactions and foreign trade actors. For this purpose, TREID uses a technological platform where it enables certain uses and tools for the consultation of information by users and based on the plan contracted by the SUBSCRIBER. The only uses allowed to Subscribers are 1) the creation of their profile; 2) access to the platform to access and navigate the databases; 3) creation of information filters; 4) downloading of information through reports generated in the system (the maximum limit of monthly download of information per subscription regarding detailed reports is three (3) million records); and 5) modification of identification credentials. The information consultation service that is made available is solely and exclusively related to public information on foreign trade of the Republic of Colombia, without information originating in other countries.
4. Responsibility
Considering that the service provided by TREID consists of making purified public information available and allowing its consultation, its responsibility and that of its officials, it is limited solely and exclusively to such provision; The user is responsible for the analysis, use and application of the information, and without TREID assuming any responsibility for the positive or negative consequences that are generated for the user by the use or interpretation of the information.
5. Value and Payment
The amount to be paid to the Subscriber will be the one reported to the Subscriber at the time of contracting the service and according to the selected service plan. The value of the service and the plan will remain in effect until the expiration of the contracted period, but TREID may freely change it for future periods or contracts, even when they are automatic renewals. The payment transaction is carried out by bank transfer, credit card or the Secure Online Payments (PSE) system, where at the time of the operation you will be informed of the specific conditions thereof and the security certificates of the operation system.
TREID, expresses that by virtue of the technology adopted, it does not store or conserve credit or debit card data, which, when supplied in the payment method, are encrypted, making them impossible for TREID to know during the process.
6. Advertising.
TREID may use banners, links, hyperlinks and other redirects to third-party websites or microsites on the www.treid.co web portal; These tools are of an advertising nature and at no time correspond to services offered, endorsed or controlled by TREID, for this reason TREID is not responsible for their content.
7. Information collected
The Subscriber when creating his profile voluntarily provides the following personal data: Email, Password for access to the virtual platform of TREID, Name, Surname, Telephone / Cell phone; information that you supply directly to TREID, thus acquiring the status of Data Controller. TREID, as the owner and operator of the platform, reserves the right to maintain the client's registration in force when the client has not provided truthful information, when it treats the information in a manner contrary to honest uses or when it breaches the policies contained herein or any of the obligations, duties and charges that it acquires when registering on the web portal.
8. Purpose of the information collected
The personal data provided freely, voluntarily and autonomously by the Subscriber, is intended to be subject to administration by TREID for the creation of a user account. The processing of personal data implies; The recollection; storing them on the TREID server; their circulation within the TREID organization; those that are pertinent will be processed by TREID to communicate commercial, advertising and marketing information related to its commercial activity to the Subscriber. Likewise, the data collected will be analyzed in order to improve the business strategy of the web portal, supported by business intelligence and data mining tools, which allow acquiring prospective knowledge for prediction, classification and segmentation purposes.
9. Responsibility in supplying the information
TREID informs the Subscriber that the provision of the requested data is their entire responsibility, which is why they must be true and reliable. As it is an unequivocal manifestation of the will, it exempts TREID from responsibility for their quality. TREID assumes in good faith that the information provided by the owner of the data is up-to-date, accurate, truthful and reliable.
10. Habeas Data
If the subscriber were a natural person, he / she may exercise his right to know, update, modify and delete the personal data existing in the databases associated with our web portal. To do this, you must make a request for consultation, claim or deletion to the email address contacto@treid.co, detailing the modifications to be made and providing the supporting documents.
11. Intellectual property
TREID expressly states that it is legitimized for the commercial operation of the web portal www.treid.co in relation to brands, banners, slogans, images, applications, platforms, databases, therefore, access to the services offered is adjusted to current Colombian regulations on intellectual property. The Subscriber may not use, commercialize or exploit in any way for his own benefit or that of third parties the industrial property rights made available by TREID on the web portal www.treid.co. The Subscriber must respect all the copyrights of the creations that are made available on the web portal www.treid.co, consequently, they will not be able to i) reverse engineer, decompile, derive source code or the like; ii) enter areas of the platform to which authorization was not granted; iii) carry out acts that violate security and restrictions.
12. Electronic Commerce
In compliance with the Colombian provisions on data messages according to Law 527 of 1999, it is reported that national legislation recognizes the validity of data messages and therefore they acquire a probative character and entity. Consequently, the clients of our web portal understand that, through the crossing of data messages, the intervening parties can give rise to the birth, modification and extinction of obligations, the content, consequences, responsibilities and effects of the information generated being their exclusive source. .
For the purposes of preventing computer fraud, it is suggested that the user enter the IP address or domain name of the website they wish to visit in the URL of their browser, however they can access from the portal.
13. Regulations
The services offered through the web portal www.treid.co are offered in compliance with Colombian commercial regulations. Those who access the website from countries other than Colombia do so on their own initiative and are subject to Colombian commercial regulations.
14. Modification of the terms
The Subscriber understands and accepts that TREID may modify these Terms and Conditions of Use, unilaterally at any time. The changes will be effective the moment they are posted on the www.treid.co website.
15. Full acceptance of the terms
The Subscriber declares to be of legal age, declares that all the information provided has been real, truthful and reliable; Therefore, you expressly and unequivocally state that you have read, that you understand and that you accept all the situations regulated in this Terms and Conditions, for which you agree to full compliance with the duties, obligations, actions and omissions here expressed.
